Do you have to include a minor misdemeanor for disorderly conduct on a job application, and will that be on background check?

I am trying to get back in the healthcare field. Will having a disorderly conduct charge that is eligible for expunge in a year make me unable to get a job? The disorderly conduct was originally a petty theft charge, but they lowered that and I already paid all the fines. Will the background check say it was lowered from petty theft to disorderly conduct?

I'm not sure if the background check will show the charge was dropped. However, court records may show an amended charge to disorderly from theft. Also, if the application asks if you have been convicted of any misdeameanors, then you would have to put it down unless you want to risk it. If it asks if you have been convicted of any crime of deceit or dishonesty, then disordely conduct will not be a crime of deceipt or dishonesty. It really depends on how the question is asked on the application.

First, it would depend on the type of question on the application. Is it asking for felony convictions or all convictions. Second, pending on the type of background check, it will most likely show the original charge (theft) and a disposition of disorderly conduct. If you have any doubts about how to answer the application questions, then I would suggest that you have an attorney look at, especially if you are trying to get into the healthcare field.
