I-94 and EAD
Anonymous2 views3 answers
i am applying for my husband's adjustment of status who came here with K-1 visa... we got married within 90 days of his entry here...
my questions are:
1) does he really need to apply for I-765 (or it's our own choice?)
2) i sent the original I-94 to USCIS with his application (I-485, G-325a, and I-864), is it gonna be a problem since we don't keep the original?
If he wants a SSN he will need to have the EAD card or wait until he gets the AOS approved. Thus, the EAD is not necessary to remain in status but if he wants to work before he gets the AOS approved, it is necessary. Keep a photocopy of the I-94 for future use and if it is asked for again in the future you can state it was submitted with the AOS package.

I agree with Attorney Abott. You should have kept the original I-94 for your interview but will be fine if it is still in the file at the time of your interview, the officer accepts a copy of it, or you have also an entry stamp in your passport.
In Los Angeles, the interviews are coming in so fast that often it beats the printing of the work authorization card. It doesn't cost any more money to get a work permit, just the form, copy of his passport, and two photos. The missing I-94 card shouldn't be a big deal since its usually in the file at the time of interview.
