Michigan Bench Warrant issued in error what can I do?

Business 4 views 2 answers
I received a show cause court date for non payment of child support. I did not realize the payment had stopped being taken right out of my check. I called the court as soon as I got the order and spoke to the admin of the referee. I explained what happened and she said she would adjurn the court date for a later time and if all payments were made between now and then there would be no need to appear. I made all payments leading up to the next court date and also received a letter stating that I did not need to appear as long as payments were made. I just received a letter stating there is a bench warrant for not appearing. The bond is for $3,000 of which I do not have. I turning myself inthis week and bringing all I have which is about $100 and my proof.

It sounds like if you appear they will release you without a bond and will recall warrant based upon the fact that you are current in child support.

Before you report to the Court go to the Friend of the Court which administers your child support and tell them what is going on. Get a receipt showing your payments are up to date. Get the name and phone number of the person you deal with so that you can tell the Court who you dealt with. Whenever you are told anything like the hearing is adjourned (1) always ask for the name and phone number of the person you are dealing with, and (2) ask them to send you an Order or letter adjourning the Hearing.
