One of our adjacent neighbor complained to us and Landlord of our baby girls crying noise is disturbing him during night times around 2 AM or late sometimes and he is not able to sleep due to that and it affects his work. At the same time we have been trying to adjust with our 3 month old baby and try to make her sleep in our living room as its a 1 bed room apartment and our bedroom walls are common and very thin. But my wife and the baby cant always sleep in the living room on an old mattress as that causes back problems for my wife and the baby is uncomfortable as well. The baby just cries for couple of mins before we take care of her, breastfeeding and we also get to the living room so that there is less disturbance. Is neighbor having sleep issues that a minor crying disturbs him?Thank?

Dont worry about it. You cant get evicted for your newborn baby crying at night. IN New jersey, A LL can only evict you only under one of the causes or grounds for eviction listed in the Anti-Eviction Act. The only cause that could even remotely be correlated to your situation is "Disorderly conduct that disturbs other tenants." However, although the baby crying might disturb neighbor, your conduct wouldn't be disorderly. Call my office for more free advice (609) 390-8888

I agree with counsel. There is no basis to evict.

You will not be evicted. Sounds (pardon the pun) as if you have a problem neighbor. Make sure you memorialize all instances of his indiscretions and talk to your landlord. www.GardenStateLaw.Com
