I have hearing for cancellation of removal
My attorney told me that my wife is not part of the case because she has been here only 3 years and we have twins together she is aslo illegal , is that true that she is not part of the case

I would suggest you to speak with attorney who handles your case, according to the law he is correct she cant be part of your cancellation of removal case

If your wife is illegal, then she is not a qualifying relative for cancellation of removal purposes.

However, if you win your cancellation of removal case and receive your residency, you then may sponsor your wife for her residency, provided she is not ineligible due to prior deportation, criminal history, multiple unlawful entries to the U.S., or other inadmissibility grounds.
