Given the fact that he is charged with bank robbery it is likely that he will be facing these charges in federal court as opposed to state court. The sentencing guidelines are drastically different in federal court. Without going into the ranges, which can differ based on the allegations, this person is facing a significant amount of time in the department of corrections.

This is going to be difficult to answer with our knowing exactly when the prior felonies were committed and how much prison time was served. You need to consult with an attorney and bring all of the information with you. If both of the felonies are still allegeable, and your friend is charged with a class 4 non-dangerous felony, he would be looking at 6 - 15 years. This is just a guess on how your friend was charged. Robbery can be charged different ways. If their was an accomplice it would be a class 3 felony and he would be looking at 10-25 years. There may also be additional charges you are not telling me about that can run consecutive. Your friend needs to consult with a lawyer immediately. This is an extremely serious charge. If in fact you are charged or to be charged with "bank robbery" I agree with Mr. Cantor. You are likely to face federal robbery charges, an entirely different set of rules/laws etc. Feel free to call if you need more information. Good luck.

Hello -- the failure to use a weapon helps, but it is not going to result in much leniency. The prior felony is not going to help much either, although the age of the conviction is something to be factored into the court's analysis. This case is going to end up in a federal courtroom, where there is little discretion in sentencing. The person in this jeopardy is looking at several years behind bars. The facts of the case will help to determine the exact figure. Were children involved. Were elderly individuals involved. Were threats of bodily injury used? All of those things matter so it is difficult to answer the question with too much specificity. Good luck!
