I’m a former TVU student. My h1b was approved without the i-94 from. My employer applied for the h1b visa through a house project. Now I got a job offer from another client, so I need to get a visa stamp for the new project. Should my employer apply for an h1b amendment before I get my visa stamped? If you mean to say that a new employer wants to hire you in H-1B status, the employer must file a new visa petition plus all applicable fees for you.
Whether you will be able to change your status without leaving the U.S. depends on your current status. It is not clear from your question whether you maintained status. Since you were not issued new I-94 through initial H-1B petition, it did not extend and change it. You better consult with an immigration attorney about your case.
