Marijuana charge in U.S. as Canadian Citizen over american border?

Business 2 views 3 answers
I am a Canadian citizen, and bought 1 gram of marijuana in St. Maarten, I then went back on my cruise, and the next stop was St. Thomas. I got searched in St Thomas and was escorted to the airport border security and detained for 1 gram. Will I ever be allowed to enter the U.S again? If so, how long?

It is not advisable to make any admissions on as it is subject to public access and review. It would be necessary to examine the criminal charge or adjudication in St. Thomas which is a US Territory. You should collect all of the information you have concerning the criminal adjudication and request a legal opinion from an experienced immigration attorney who is aware of the criminal laws of the US Virgin Islands.

You should be eligible for a petty offense exception which will allow you to enter the US. My office often assists clients from Canada with situations like yours - it actually happens often between Canada - FL - VI's. Call us for assistance when you desire to enter the US again. I can prepare a legal memorandum for Border Patrol that you present to the officer when you enter the US. Kyndra L. Mulder, Esquire (904) 296-7702
