Does the i-130 expire

Bankruptcy and Debt 2 views 3 answers
I went to the immigration office where we filed to withdraw the i-130 and was told that the file was sent to Missouri and it was "dead in the graveyard" What did that mean? Did the i-130 expire since no other paperwork was filed since 2010? Should I still send a letter to withdraw and where should I send it?

Some of the time, the I-130 will be denied due to abandonment. This may have been the case here. You should consult with an immigration attorney to see what options you have to properly withdraw the I-130. Who was the I-130 for? Was it for a deceased relative? Was it marriage based? These are questions that an experienced immigration attorney will ask to determine the best course of action. Good luck.

If the I-130 was approved, its approval is permanently and an adjustment of status or consular processing is doable, if according to the visa bulletin or the preferences categories a visa is available. If the I-130 was not approved, and additional evidence was requested, and never answered, the I-130 is deemed abandoned. An Immigration attorney would be able to find the actual status on your I-130 and guide you about the best course of action.
