I-601 Waiver -- do we have a chance to be granted?

2 views 3 answers
My husband applied for an immigration visa from the USCIS in China. We expect it to be denied because we discovered is "wanted" for 2 crimes in a 3rd country. Do the below reasons give me a chance to have the waiver approved? 1. My mother has end stage renal failure (personal hardship) 2. A US govt scholarship I received in college contractually requires me to work 1+ year for the govt 3. I'm ineligible for a working visa in China -only 90 day tourist visa (financial hardship) 4. I plan to do a master's in the US (loss of educational opportunity) 5. My husband's job in China pays $400/month (financial hardship) 6. He wants to become a Chinese teacher, an area of high need b/c we do not have enough qualified people for the increasing demand for Mandarin teachers (special factor) Advice?

There is a possibility. A lot is going to depend on the criminal charges and the eventual outcome. Sent on the Sprint® Now Network from my BlackBerry

I agree Waivers are difficult and it is best to retain a lawyer who can help you with this IF you "like" this answer, please visit our website www.immigrate2usa.com

I agree with my colleagues. You need to retain an immigration attorney who has had extensive experience with preparation of waivers.
