How long does a contractor have to bill you?

I had an excavation company do some digging at my home. A verbal price was discussed for cash. No contract was done. 3 YEARS went by, I had asked the guy a few times for his bill, he always said yup, he'd get it to me. Finally I sold my home, 1 month after closing I got a bill and it was $1400 more then talked about 3 years earlier with no interest being charged. I ignored it as I had changed residences and had written off ever getting the bill a long time before that. Now 2 YEARS AFTER that, so 5 years after the work his partner has shown up at my door DEMANDING the amount plus interest since the bill was sent 2 years ago. What should I do??

However, there is a statute of limitations to bring a claim. The contractor must bring this claim within 6 years of doing the work in order to be able to recover. If 6 years pass, the statute of limitations will expire. There are also other issues that you may want to explore with an attorney. For example, most home improvement contractors (depending on where the home is and who the licensing authority is) are required to be licensed and provide you with a contract in writing. Failure to do so has certain consequences for the contractor and his ability to charge you. I suggest consulting a construction attorney in your area.
