Can someone MAKE me file a 10 99?
Anonymous2 views3 answers
I lived and took care of an elderly woman. Her son paid me every week form a trust fund from april 2011 to jan 1 2012. He fired me due to money problems, since then he had a private investagator call me to get my address so he can send me a 10 99. Do i HAVE to give him my address for him to send me a 10 99? Also can he MAKE me fill out a 10 99? Thank you very much for your help.

I believe if you make over $600.00 as an independent contractor, then you are required to fill out a 1099. Your former employer is going to report to the IRS that they paid you as a 1099 employee, thus, if the IRS knows you've made a 1099 earning, and you don't report this as your own income, then you may be fined by the IRS.

You should have received a W-2 because you were technically an employee. The son should have paid you like any employee ,and taken withholding out of your check. You can report him to the appropriate authorities in Florida for failing to do so.
As for the 1099. This is not your responsibility. However if you are sent form W-9 you should take it to the authorties to show that you were improperly paid as an independent contractor when you should have been an employee.
its actually 1099 (one thousand ninety-nine) the term of art is 1099. The form you will receive is actually a 1099-Misc. There is nothing for you to fill out. This is a form for the payor (son) to report payments for independent contractors. You need to consult a tax attorney or income tax preparer in your area to discuss your reporting obligations. The income you earned for the work is taxable. The son is looking to deduct the payments on his mother's tax return. That is why they need to issue the 1099. When they do so, the IRS will know you earned income and if you did not report it, they will most likely come after you. AGAIN, I encourage you to find a tax preparer or tax attorney to discuss your situation.
