The eviction process is fairly straightforward and pretty user-friendly, as most landlords do not always have the luxury of an attorney to assist them. You and your husband have big hearts, but its time to get these crooks out the door. Fortunately, the law is going to be with you on this one, even though you're at least 3 years late in taking care of this.

You should evict the tenants. You should consult the Texas Property Code and follow the eviction steps. Once an eviction notice is posted, you are able to file an eviction in the Justice of the Peace Precinct where the rental home is located. The entire process will most likely take 30 days unless the tenant appeals to the County Court.

Make sure that you follow the instructions precisely, or the JP will not evict them, but will give them another month as you redo the paperwork. Having said that, as long as you are careful, you'll get them out. Next time, start the eviction process the day that they are late. You taught them to do scam you.
