Are recording fees, recording taxes and title insurance considered closing costs?

My agent (dual agent by the way) tells me that all closing costs will be paid by seller-I have written proof. I even tell him that I only have enough for the 5% downpayment and he says don't worry all closing costs will be refunded to you by the seller after closing. Then at the closing he tells me that I won't be reimbursed for recording fees, recordation tax and title insurance-about $2,000 because these don't count as closing costs? Is he wrong and would this be covered by his erros and omissions insurance because I dont have a lot of money for an attorney-can anyone help me please? Thanks
