Daughter's age at time of death 21. Mother and father legally divorced since 2002. Daughter sole beneficiary of will. Father requesting all personal property. Sister of deceased named personal representative of estate which includes house and personal property. Daughter does not have the time or desire to handle the financial affairs and would like father to take control in the state of Florida.
I'm not sure about Florida law, but in Texas there is a way to have an un named person appointed as independent executor when all heirs agree. Sounds like that is what you have here. Try contacting a Florida Probate lawyer and see what they say.
If the deceased was a resident of Massachusetts when he passed, then his estate will need to be probated here in Massachusetts. If there is real estate in Florida, then ancillary probate will need to be opened there as well. If all parties agree, it is likely that a court would permit another individual to serve as personal representative.
