Right to sue letter/ division of civil rights

Civil Rights 3 views 1 answers
I filed a complaint with the division of civil rights requarding a bullying incident with my 11 year old daughter in public school. it is going on 2 years now and I am afraid that without a right to sue letter I will not be able to take the school district to court. Is there a way to get an extension to sue in court or do i just wait for civil rights to produce a right to sue letter. I am afraid i will loose my case if they take too long.

You are strongly advised to seek counsel immediately. The (two year) statute of limitations may be about to expire, depending on the nature of your claim. In addition, because you are suing a Public Entity, the Tort Claims Act may be applicable - along with the required 90 day notice period - which has expired. The DCR generally handles discrimination claims - you may have been able to sue *directly* in Court - and even Federal Court under 42 USC 1983 and other statutes. Please obtain your paperwork regarding the DCR case and see an attorney as soon as possible. www.GardenStateLaw.Com
