If I don't pay Walmart's civil demand?

Criminal Defense 2 views 6 answers
I'll only give facts. I'm 19 was caught stealing item that was under $25, damaged. They took no photo, no police. I signed something all I remember it stating was "I recognize I am over 18" and something about a sheriff. The demand is too high for me to pay so I if don't pay will they press criminal charges since they haven't? will they sue me? will it affect my bank accounts and or credit? can I try to negotiate a lower demand fee without a lawyer? (I read on the website that is possible, but not sure if it works) Thanks.

Nothing happens. A civil demand is not a debt and you would only have to pay it if they successfully sued you. The likelihood of that happening is extremely small. Paying or not paying the civil demand will have no effect on any criminal actions which might be brought against you. It also has no effect on your credit score. There is no need to negotiate a lesser amount. It is not a "fee".

Nothing whatsoever will happen if you don't pay the demand. It will not affect any possible criminal action that might be brought against you and cannot result in levy on your bank accounts or impact your credit rating. Believe the lawyers who have been preaching this for years.

If you don't pay it they would have to sue you. That is unlikely.

If the police weren’t called and you weren’t arrested then you don’t have criminal charges pending against you. I generally advise clients to disregard these civil demand letters. While they are legally permitted to send you the letter, the truth is that you don’t owe them anything and they are just hoping you don’t know better and send them money. In order for you to owe them money they would have to sue you and win. The cost of them doing so is far greater than any amount they can ever hope to recover and as such they really don’t pursue. Ignore the letter and the next one if it comes (it costs them virtually nothing to send a letter so them may send a couple).

As all the other attorneys have said, you don't need to pay.

I join the overwhelming consensus on . Do not pay, do not respond. They will move to the next person on their list of thousands.
