I pay child support on a 5 year old girl. I don't get to see her or talk to her on the phone.Everytime i try to call her my ex wife will tell me no i can't talk to her she calls me names and hangs up. i am not behind on my child support. We have went to court i have visitions but i don't ever get to see her. We have court paper stating i have visition, but my exwife does not follow them. What is the next step i can take? so i am able to be a part of my childs life. My ex wife says since she is miltary no one can do anything about this. my visitions have not been taken away from me i have never had any. I don't have a lot of money to get a lawyer. How can i get visitation with little money
You definitely need to file a motion for contempt. Parenting plans are court order. No one gets to override a court order. Just because your ex is military doesn't matter. A court can and will enforce the court order exactly as written.
Contempt is something you can actually do yourself. Go to the courthouse where the parenting plan was entered and ask at the clerk's office about what forms you need and if there are any resources (clinics, courthouse facilitators, etc) that can help you fill out the forms correctly. Follow every instruction to the letter.
Act promptly. The longer you let her control the situation, the harder it will be for you to get the court to act. I'm not licensed in IL, but here in WA if you are found in contempt for not following the visitation part of a parenting plan 2 times in a 3-year period, it's grounds for changing custody. Maybe IL has a similar law.
No matter what, you need to stand up for yourself so you can have a great relationship with your child.
