What should I do if a police officer marked the accident report wrong and the insurance company is saying i hit the husband?

I had a car accident 2/12/12 The officer never took my statement down nor did he fill out the accident report right. He claimed it was my fault because i didn't wait for the light to turn red to turn however the light had been yellow for four seconds and i had checked that all cars were slowing down. The lady had enough time to stop and her insurance company is claiming i hit the husband not the wife. The officer said it was raining and that i hit the grill of her truck but it was only clipped in the drivers side bumper the car. What should i do?

Police reports are not evidence, so I would not be too concerned about the error in the report. You will have to give your insurer notice of the accident and inform them of the error in the report, then let the insurance companies fight it out. That's what you have insurance for: your liability coverage covers the other driver's damages and injuries if your insurer agrees you are liable. If your insurere does not agree, then they hire and pay a lawyer to defend you.

Turn it over to your insurance company. Tell them what happened, and don't worry. They'll figure out what happened, and defend you.

Police reports are used by insurers to apportion fault but, with very limited exceptions, do not get admitted into evidence in Illinois courts. Unless the officer witnessed th incident, it becomes a he said: she said case. I suggest making claims with all insurers (her's, your's) and seeing who covers what. Without injuries, it is likely not worth pursuing further. Your best option is having yourcarrierfix yourvehicleand subrogate to go after her carrier. Stephen L. Hoffman Law Office of Stephen L. Police reports are frequently wrong. If you were issued a ticket, you can fight the ticket. Also, you will want to report the accident to your insurance company to resolve.
