Debt collection lawsuit negotiation
Anonymous3 views3 answers
I have 7 days left to respond, i talked to the lawyer representing the plaintiffs today, he said that there would be legal fees attached to the $1,700 i owe, i have the $1,700 but not the $2,400 hes requesting i pay for his legal fees. what can i do to minimize costs here? i want to pay this debt, i want to stay out of court but i cant afford to pay more than $1,800
You may have missunderstood his request, or I missunderstood what you were saying. Perhaps it was $2,400 to pay the debt and the attorneys fees combined?
Assuming he wants $1,700 plus $2,400 for legal fees, you might consider not filing an Answer. If you do not file an Answer to the Complaint, the Court will issue a default judgment. The default will likely include an award of attorney's fees. But I highly doubt the Plaintiff's lawyer will ask the judge to award $2,400 for attorney's fees.
You should consult a local attorney about the default process in Idaho.

You should speak with an Idaho attorney to evaluate your case. Has a lawsuit been filed against you yet? I agree with the other comments, but you should still contact the collection attorney to discuss a settlement.
Nothing short of a personal consultation with an attorney that regularly deals in collection matters will meet your needs. There are limits in what the collection attorney can obtain in attorney's fees in any judgment against you, but by far the best strategy is to get an attorney to negotiate for you before any judgment is entered. While you are at it, you would be wise to have experienced bankrupty counsel review with you all of your options. If this is not your only financial problem, you need to look at the big picture. Responsible bankrtupcy attorneys do not just sell bankruptcies; they are the experts in your issues. D. Blair Clark in Boise is such an attorney.
