First, did you have your student status reinstated? If you are in valid F-1 student status, you should seek Optional Practical Training (OPT) after you graduate. With this, for up to one year, you may be employed in a field related to your studies. Since you will be graduating in August, it may be too late for you to seek an H-1B Visa (which are still available, see http://www.uscis.gov/files/article/H-1B_count_20apr09.pdf). If you can OPT, then next April 1, 2010, you should apply for an H-1B Visa, which will then allow you to temporarily extend your OPT until your employment would begin on October 1, 2010. Note also that if you are going to seek to work as a nurse, the H-1B Visa is limited to professional nursing fields which require a bachelor's degree (such as clinical nurses and upper management nurses), so please also keep this in mind when selecting your career. Also, critical important to all healthcare workers is that they meet the Visa Screen requirements (see http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=c55878a814f0e010VgnVCM1000000ecd190aRCRD&vgnextchannel=48819c7755cb9010VgnVCM10000045f3d6a1RCRD for more information). You should consult an attorney for more information and evaluation of your professional credentials. As well, you should consult your school's designated official to inquire before you graduate about obtaining OPT. Otherwise, your options may include one of several other temporary visas, which may not be desirable because of the limitations placed on them. Note, most out-of-state attorneys can legally help you because we are permitted to practice federal immigration law outside of our state of jurisdiction. Michael A. Harris, Esq.
