My boyfriend was arrested on this charge by WILCO. (I don't know what the substance was) I just want to know what could happen and if the outcome is better or worse depending on the substance itself? (he's never been charged with anything like this before)

Thats a third degree felony, and the punishment range is 2-10 years. The type of substance involved does not affect the punishment, but realistically, there are not that many substances that fall into Penalty Group 1 and are common criminal offenses. Cocaine is by far the most common, others would be meth, heroin, PCP, and a few of the hardcore narcotics along the lines of morphine, methadone, and oxycodone. If he's never been charged with anything else, he would be probation eligible, but that doesn't mean he'll necessarily be offered or receive probation. His odds are improved if he can go ahead and get a good attorney early on who can look into his case, find out if there are any potential issues there that might help him, and get him the best disposition possible.

Ms. Foley is right from a penalty and sentence standpoint. You need to hire a lawyer for him. Since this is his first offense, he may even be eligibile for a pretrial diversion program and a lawyer will best know what the options open to him are. Good Luck.
