Three and a half years ago my brother was charged with Cyberstalking, ID Theft, and Harrassment through electronic communications. The case was dismissed without prejudice in August of 09. What is the statute of limitations on these? Thanks.

For a misdemeanor, the statute of limitations in Illinois is typically 18 months from the date of the offense provided it was a state charge. If convicted for a minor offense, the violator could be punished up to 365 days in jail and or $2500 fine. The prosecution must have time to conduct a thorough investigation. If the case was dismissed without prejudice, the prosecutor has the same 18 months to re file the charges or reindict the individual by a grand jury for the same alleged offense. It appears that the Statute of Limitations has lapsed on the above. However, if any of the above were federal crimes, the Statute of Limitations for such crimes could be five years. Usually, In Illinois, consumers have three years from the date of discovery to bring legal proceedings against an individual or business for identity theft.
