Employment based green card

3 views 3 answers
If I fall under EB3, can I concurrently file I-140 and 485 (EAD also)? if 140 is approved, will I get EAD despite the long wait before priority date becomes current? Can I work using the EAD while waiting for priority date to become current and obtain green card? What does my status become after filling? I am currently F1, must I change my status to h1b or am I fine with EAD while waiting? Thank you all.

It depends in your priority date and your country of birth. Consult an attorney Www.immigrate2usa.com

The I-485 can be filed only when an immigrant visa is immediately available. If your priority date is not before the one listed on the Visa Bulletin, all that can be filed is the I-140. Since this is employment-based, your sponsoring employer probably retained an experienced immigration attorney to file the required paperwork. I would strongly urge you to speak with that attorney. Good luck!
