How early can I get off a five year probation sentence in New York?

I understand that I can get off early and how to go about doing so, at least through my probation officer, who supports early termination. I just need a time frame for the earliest I can do it. It is a felony charge and took place is Nassau County, New York.

2 1/2-3 years on a 5 year probation sentence. It's not a guarantee but you can try. Good Luck Joseph Am Lo Piccolo, Esq. President, Criminal Courts Bar Association 11'-12' Hession Bekoff & Lo Piccolo

I agree that you probably would have to do at least half of the time on probation. If a good reason comes up, such as probation limiting employment options, you can try earlier but it would be an uphill battle. Your probation officer should be able to discuss what the best time frame is before applying for early release. Good luck.

You can be terminated (favorably) from probation early but I imagine you would have to complete more than half before it would be considered. There are many factors that are taken into consideration and you could and should discuss them with your probation officer at an appropriate time (I believe it may still be way too soon). Three years is about the right mark. In the meantime the better you progress while on probation the less supervision will be required (ie less checkups, less visits, etc.) which could make it less burdensome.

There is no really time frame to get off probation early. The longer you are on probation the better chances you have to get off. I would not advise to start the process if it has been less than 2.5 years. Also, if you do well on the program (if any), doing well in general, the judge more likely to get you off, especially if probation does not object. Rovshan Sharifov, Esq.
