"Cutting corners" in Chap 11 bankruptcy: What will happen?

2 views 3 answers
I've been in Chap 11 bankruptcy for about four months and things have not been going well. The court has revoked several automatic stays, denied my requests for compensation, etc. I was so upset with the way things were going that I didn't file my reorganization plan (it was due 2 weeks ago), have fudged some forms, and fudged some details about my debts. Now I am worried because the court and my creditors are catching on: The creditors have begun filing papers talking about my "mistakes." The judge hasn't yet said anything about the creditors filings. What can I expect? Dismissal of bankruptcy? Conversion to Ch 7? Penalties? I'm nervous but I will not hire an attorney. I represent myself in court because this is my right! Please advise what consequences I can expect so I can be prepared

If you are filing false documents in a bankruptcy, you could be charged with perjury and bankruptcy fraud among other things. You could be fined and imprisoned for up to 5 years. See 18 USC 151 through 158

Expect the U.S. Trustee to look into this very soon and possibly to refer your case to the U.S. Attorney for criminal prosecution. You will also have the right to represent yourself there and the right to do your own time if you're convicted.

Sometimes persistence and a desire to do things yourself can be good things. This is not one of those times. My advice to you is swallow your price and find an attorney who may be able to set things straight. Do it right away. Being imprisoned for federal bankruptcy fraud is the kind of thing that will follow you always.
