I have a warrant for failure to appear in court for summons (Bronx) on 2/2/2012. What now?

I was issued a summons for smoking in an elevator on 11/19/2011. I missed my court date on 2/2/2012. I live and work in Pennsylvania and had lost the original pink summons. I was told yesterday I have a warrant for failure to appear. What should I do? Can I have the warrant recalled without being detained?

On a summons like this, you can retain an attorney to represent you in court without your having to appear. The warrant will get vacated and you may have to pay a small fine. I do this often for users. I am a former federal and State prosecutor and have been doing criminal defense work for over 15 years. You should make arreangements to return on the warrant voluntarily and you are not likely to be detained. If you delay and are stopped, you could then be detained. You can return to court voluntarily and you probably won’t be detained. Otherwise, so long as there is a warrant you can be arrested at any time. If you are out of state you may want to consider contacting an attorney who could try (emphasis on try) to take care of it for you without you having to return.
