Can my daughters father get unsupervised visitation if he has hepititis C.

Child Custody 2 views 1 answers
My daughters father and I split up after she turned 1 due to him being on drugs. After we split up he told me that he had Hepitis C. HE knew he had it but never told me and therefore had put us in danger. I let him come visit her when he would ask but he would only stay for about 5 minutes. I eventually quit letting him see her because he was still doing drugs. Now our daughter is over 2 and 1/2 and he wants to take me to court to get to see her. Will he be able to get unsupervised visitation with her considering he has that and so does alot of his family? His family he stays around also has a history of drugs and criminal charges.

You should present your concerns in an affidavit at the court hearing. If your dauther's father is still using drugs, then I doubt that a judge would allow unsupervised visitation. If he can prove that he is clean from drugs and will not place your daughter in unsafe situations, like being around others who use drugs, then he can make a case for unsupervised visits (assuming he was adjudicated or voluntarily acknowledged being the father). I do not know Tennessee law, but I do not think having Hepatitis C necessarily precludes unsupervised visits. I believe that disease is transmitted through contact with the infected person's blood. If your daughter's father is deemed to be responsible for preventing that type of contact, and no other major risk factors are present, then I think a court would allow unsupervised visitation. You would be better prepared for the court hearing if you were represented by a local family law attorney.
