I 797 has wrong valid from date

I have a question regarding my h1b approval. I noticed that validity period of my I797 is from Jan 2 2012 . The reciept date of petition is Oct 10 2011. My Old visa and I 94 expired on Nov 31 2011. What is my status for December 2011. Do we need to get the dates corrected. If yes what is the process and how long does it take to get it corrected.

These are questions that you need to speak with your employer's immigration attorney about, because they have access to your complete information and file. If your employer does not have an immigration attorney, I highly suggest that they hire one as soon as possible.

As long as your H1-B extension was filed before your I-94 expiration date, you're in the clear and nothing needs to be "corrected".
