Moving from VA to MD with a restricted DL

DUI 3 views 2 answers
Received a Restricted DL for a DUI. 1 Yr restricted and 6 months with an interlock device. I have just been given a promotion and will me moving to Maryland. Here are my questions: Will MD reciprocate the Restricted DL when I apply for one? Or will they just allow me to get a DL without restrictions? Will I legally be able to drive from VA to MD after having the interlock taken out in VA, and before having it installed in MD, if MD decides to reciprocate? Or would it be advisable to drive up (3 hours) to MD, and have the same interlock company remove one and install the other? Thanks!

VA can't tell MD what a resident of MD can and cannot drive on.

I am a Virginia Lawyer, and I deal with folks living in Maryland all the time. You may have a problem since you have already been convicted. Maryland will not just issue a license when you move in from Virginia, and the probably won't issue you a restricted license either, since they simply don't do things the way they are done in Virginia. The word "reciprocal" used so often in these contexts is a mis-nomer. Maryland will honor a license from Virginia so long as you have permission from the Virginia Court to Drive on the restricted license. The problem will be in making sure that you have the correct addresses for both your residence and employment on your license. You don't say which Court convicted you. If that was here in Fairfax, I'd be able to go in and ask the Court to modify your addresses and give you permission to drive to and from work. If you are in Court in Charlottesville, then it may not be something that they will give you down there. Here in NoVa, it is common to have a restricted license that allows driving across state lines. Not so much in Piedmont.
