car was agreed to be returned at a certain time and was not.i was not there at the time to see it not returned but the person i loaned it to wont return my calls.
I'm not sure I understand your question. Have you reported your car stolen? Was the car stolen?
If you loaned your car to someone and they have not returned it you should call the police immediately. A stolen car will undoubtedly initiate an insurance claim, and the first person the insurance company is going to investigate is the policy holder. If you are that person you want to make sure the insurance knows you did everything in your power to alert the police of the theft.

In Florida, intentionally depriving someone, even temporarily, of their possession is considered theft. As a prosecutor, I had the misfortune to discover during trial the 'rock rental' defense, where the thief claimed he traded use of the car for drugs. Not saying that happened here, but I didn't turn around and file charges on the car owner because the thief was lying. I wonder what other facts are relevant here?
If I understand correctly, your car was not returned when it was supposed to be returned. That is theft. Your choice is to either call the police and report it stolen, or you could file a civil theft suit but even a civil case will be made a lot easier with an actual police report. If you are in doubt about what to do, hire an attorney.
