my ex-wife filed a child support modification april 2010 the judge ruled in september 2011 after checking my finances that I owe $1700 arreage which I have never not paid my child support plus she got a $100 increase per month in child support. they said that i had a year to pay it which is $53.00 twice a month I sent her a cashiers check twice a month since august of 2011 my ex-wife went back to court in october 2011 stating that her increase in child support did not kick in yet of which they started taking out my check for the increase as of october 1, 2011 we had a cout date for 2/14/2012 and the judge ruled that I had to pay her an additional 870.00 pay march 1st because I was in contemp for not paying the increase of which I was paying her the $106.00 per month and i forgot to say that child support took $1700 out of my income tax a couple of weeks ago to pay the arreage because according to her I have not paid anything and she signed a notice w/her attorney stating that I have not paid anything toward the debt when I was paying. so it's march 1, 2012 and I was suppose o pay the $870.00 today so I took the judge proff that the took my taxes for $1700 2 weeks ago and the judge was not trying to hear anything that I had to say because I did not bring any money and that I have until tomorrow to pay the $870.00 or if not she will have me locked up in the county jail might I add as she was saying the ruling the judge turned to my ex-wife and winked her eye at her like we got him...I am totally disgusted with the legal system and it is not fair to fathers who pays their child support and just want to spend time with his daughter and be left alone. I do not have $870.00 they have taken all of my money and I dont know what to do. Might I add my house is in foreclosure due to these rulings and I do not have enough money to live on, please I need some advice quick My ex-wife from hell who is remarried and living in the home that I bought when we were dating now lives there with her new husband. Can I file an appeal get a new judge anything that can help me.

You didn't do too well representing yourself in the case in chief, and you are doomed if you try to do your own appeal. It's too late for you to ask for another judge.

Your biggest problem may be that you tried to do all this yourself. The fee for an atotrney would have been money well spent. You are disgusted with the legal system but did you follow the court orders? If you made payments as ordered -probably to the State Disbursement Unit - then you might not now be in the predicament you describe. Furthermore, have you broughyt proof of your payments when you were ion court. The longer you wait to rewtain an experienced attonrey, the more you will lost. Please don't look for online answers. Look for AND HIRE a real family law practitioner in your area.

if the judge increased the support, that means that the judge determined that your income had increased and/or the needs of your child increased. you have had your day in court. the judge can order support retroactive to the date of the notice of the filing of the petition. that is why there is an arrearage for you to pay. you are responsible for the payment of support if it is not taken from your paycheck. since you knew the support had increased, since you saw that the increase was not taken from your check, you should have made the payment yourself. there is no need to be disgusted with the legal system. you tried to be your own lawyer without knowing how. you did not pay the increase when it was ordered. the cause of this mess is you, not the legal system. you did not pay your support as it was ordered. you did not pay the increase that was ordered din sept, 2011. you are not the victim here. you may be able to appeal. you cannot now get a new judge. take all your court papers and financial papers to a lawyer now, not next month, now.
