Can I reduce an expunged felony offense to a misdemeanor ?

I was charged with a 459 and 182 felony in the state of California when I was a minor and I'm now currently pursuing a criminal justice degree in law enforcement. Although I was expunged and was only given community service, it would be difficult to be hired as a peace officer in my state. By the way, I believe the crime I committed wasn't a burglary rather it was a petty theft because of my intent to steal occurred after I entered the store.

You weren't "expunged" in California. California law does not provide for expungement. In California, juvenile records of most kinds of cases (but not all) can be sealed against disclosure and, after a certain period of time, the sealed records will be destroyed. But sealing of juvenile records does not happen automatically -- it happens in response to a Petition by the affected person. You need to get that record sealed if you have any hope of employment as a peace officer in the state of California. By the way, once the record is sealed, it doesn't make much difference which statute was the basis for the adjudication of the theft offense. Contact your attorney or the public defender and get the ball rolling for sealing of your record.

You need to petition the juvenile court to seal your record. Feel free to contact me if you'd like an attorney to do this for you. Good luck to you.
