My brother had gotten a underage in January, he's 16 and had his permit Suspended for 3 months. In march, I (his sister) called the cops on him because we got Physical, not knowing he was drunk. He now Is being Charged with a 2nd underage and it's All my Fault. Is there anything I can do to get him out of this? The cop said he'll loose his license for a year, but I need todo something to fix this.

You should contact a local attorney that has experience in Underage cases. A local attorney may have experience with the particular officer and judge involved and thereby can probably tell you about his/her experiences with those parties. Some officers are willing to amend charges to an offense that would not result in a license suspension, and some judges are willing to accept such an agreement. The local laywer could also review the citation to see if the officer had committed any errors that could result in a dismissal of the charge. First of all the best thing that your brother can do is to retain competent counsel to represent him in this matter. Underage drinking cases are not as easy to prove as one might think. I've had great sucess trying these summary cases as I've found that the police do not prepare for them very well because they think they are slam dunks, they are not. There is a poster here on . F. Dean Morgan who has done a good job on these types of matters in York County for my clients. Your brother can contact him or search for someone else in York or in the alternative contact the York County Bar Association attorney referral service. Second, we are attorney's here not family therapists so take what I'm about to say with a few grains of salt. You did not create the problem for your brother, it appears he created it for himself. I'd be willing to bet that you did not hold a bottle of booze or beer to his mouth and force him to drink.
