The GAL appointed in our case has made a false written statement.

She stated she "received from the court a notice of our status conference", related to a matter that does not involve her. She appeared at the status conference, much to my surprise (her fees are very high and my funds are quite low). I questioned how she could have received such notice from the court as she was not copied on the motion. She then stated that she sought out the notice from my ex's counsel and had a right to be there and that I had an obligation to copy her on my motion despite the fact that is was outside of her scope. She then stated she intends to charge for her services as usual. Is this proper? Do I have any means of recourse?

It is often that a GAL on an active file is present at financial motions and often they are excused from same. Frankly the GAL should have been copied on the motion and then you should have contacted the GAL informing her that since it was financial you prefered she not attend. However only a judge can technically excuse the GAL. Only a judge can say that motion does or does not effect the children. Your main recourse is that a judge needs to determine if the fees requested are appropriate and you can raise the issue when the GAL seeks an order approving her fees. In my experience, odds are in the GAL's favor on this issue though.

I believe that I answered your question posted a few days earlier. It seems that what I had answered then is exactly what was said by the GAL. What you also don't realize is that all attorneys who have appearances in cases have informaiton concerning court dates electronically on line as well as getting notices from the court of court dates. Her presence is reasonable. You will have to pay your share. Next time, send a copy of the motion to her too.
