How long should it take to hear about the insurance company settling liability?

I was in a car accident where a woman fell unconsious and ran a stop sign, hit me and totalled my car. I obtained counsel but it seems like they are not helping or answering my questions. He keeps saying we're not going to rush this but take our time but my bones are healed, and i have no other doctor appointments. My phone calls are hardly answered, meaning when i call they don't call back for weeks at a time and i am becoming very frustrated. Can i fire them and get new representation? Or will that just delay my already long process? It's been 4 months and i've heard nothing.

NYS litigation is long and drawn out and there`are many insurance companies which refuse to settle until you are at the courtroom door. You are free to select a new attorney. I have been doing NYS litigation for 19 years and NOTHING and I mean NOTHING settles quickly in that state. You might find my legal guide on selecting and hiring a lawyer helpful. You might find my legal guide on Is it Legal? Is it Illegal? helpful. You might find my legal guide on the understanding the different court systems helpful. You might find my legal guide on legal terms used in litigation helpful. LEGAL DISCLAIMER Mr. Sarno is licensed to practice law in NJ and NY. His response here is not legal advice and does not create an attorney/ client relationship. The response is in the form of legal education and is intended to provide general information about the matter in question. Many times the questioner may leave out details which would make the reply unsuitable. Mr. Sarno strongly advises the questioner to confer with an attorney in their own state to acquire more information.

This is a perfect question to ask your lawyer. Make sure he or she understands what your question is and that you understand the answer. He or she is far better situated to give advice to you. Because you are represented by an attorney, ethically any further observation may be viewed as an invasion of your attorney-client relationship. Good luck to you.
