I am on an OPT and I recently quit my job. How long can I stay unemployed under OPT?

Will it effect my H1b application with a new employer?

Unemployment should not exceed 90 days. The facts are not sufficient to say if it affects your H-1B application. Just because you quit your job on OPT should not affect your H-1B with the new employer.

I agree, 90 days is all that is allowed for F-1/OPT unemployment before you are out-of-status. Being out-of-status means that you must leave the US to get your H-1B visa at the US Consul in your home country. (Exceptions for getting the visa in other country exist, but are difficult.) ______________________________________________________________________________________________________________ Franco Capriotti - Senior Legal Counsel - Capriotti International Law - [email protected] - 1-800-716-0055 FIRST 15 MINUTE CONSULTATION VIA SKYPE, or PHONE IS FREE. I agree with the other attorneys. Also, if your OPT is expiring before September 30, 2012, then you will not be able to continue working with an employer until the effective date of October 1, 2012 of the H-1B if you are not in proper status.
