I-864 and Divorce Settlement

I am going to divorce my foreign spouse who is a green card holder. Could the judge in a state or federal court enforce I-864 as part of divorce settlement? My understanding is that the person should get the welfare from the government agency and then that agency will collect the money from me. However, is there any possibility that during the divorce case this I-864 issue could be brought and the divorce settlement could enforce I-864 obligation?

No. Only the federal government can enforce the I-864, and then only to seek reimbursement if the person sponsored receives certain means tested benefits.

this is a tricky question. i have seen only one reported case in the 17 years that the law has been on the books. the contractual provisions are only enforceable after you have received certain benefits. the plaintiff would be the united states attorney.you are better off getting child support and temporary alimony as well as court costs and attorney fees. go see ruben barrera 445 2054 for divorce help. tom
