We married in 2000 and I filed for divorce in Aug 2004, we are still not divorced because we both spent all our money fighting for custody. I want my divorce to be final but we can't afford the property settlement part of it. Is there a statute of limitation where it is just over and the divorce is granted and we keep what we have? He said he wants to fight me tooth and nail even though I believe in the fairness of the court I will be the one that will make out. My name is the only one on the house because he had filed bankruptcy before we married and I have made all the payments for the last 8 years. The property settlement will be complicated due to the purchase of stocks, bonds, collectibles, gifts , a disability settlement, credit cards ect. I just want it over without a fight.

It is true that once you have raised a count for division of assets (termed equitable distribution in PA) the court will not grant a decree until either a hearing is held on the matter or the parties submit an agreement resolving all the issues. You can withdraw the count for division of assets by mutual agreement in which case there is no bar to the court granting your divorce. Otherwise, if you are fairly certain you will make out better through the court, you should consult a local attorney about what steps you need to take to get a hearing scheduled.
