I was arrested for a DUI the first Saturday in February, it's almost the end of March and still no court date

I was arrested on 2/3/12 for a DUI, and was scheduled for court on 2/28/12. I spoke with the DA's office about rescheduling my court date because I was needed out of town for work. She informed me that my labs had not been returned, and that I would be fine to go into the Court House when I was back in town to reschedule. I've been to the courthouse 4 times. It's now 3/29, and my labs are still in limbo. I'm currently in my 30 day suspension on my license and am able to apply for a restricted license on 4/4, but if the court hasn't mandated me to enroll, what happens?? Can I find a program on my own and enroll, and if so, what information do I need to provide to the school?

That is a bit more prolonged that it usually takes for the court system to assign a court date for a DUI, that is true. However, the court system and the prosecution are the ones who bring the charges against the accused. You indicated, however, that you have appeared for status hearings four times. You also indicated that the lab results are not completed. Generally, a criminal defense attorney in order to facilitate the process would file a Speedy Trial Motion to demand trial. I do not know if that has been done in your case or whether you have retained a counsel. However, I do know one thing for a fact, the District Attorney who prosecutes your DUI case against you is not your counsel and you should take advices only from a defense attorney with whom you have a relation.

You can get extension from DMV as they cannot proceed to prove you had .08 BAC without lab results.

I note you said that YOU were in contact with the DA's office. YOU need to see about an attorney. You might try Gil Somera of this list.
