I was served to reduce child support in Tx for the 3rd time within a 4 year period. The last time I did not have counsel. The reduction was granted due to default. (I didn't respond) I was calling the court house to see when the court date was. The decree and 2nd set of amended orders has specifics to follow prior filing yet opposing counsel disregarded. In addition, opposing counsel represented his client as an employee of one company even though opposing counsel was representative at deposition when client stated he was the owner of numerous companies. Currently STILL the owner of all companies. Child support was held for 2months and reduced substantially. How do I have this attorneys actions reviewed and him sanctioned and sued for not following the judges orders?

It's hard to tell from your question exactly what you think the other attorney did wrong, but it sounds like you very much need legal counsel.

Having your child suport modify requires that the requesting party to meet a high burden. Specifically, if a modification is requested within 3 years the requesting party must show "materially and substantial" change in circumstnaces of any party involved in the case. If it has been more than 3 years since the last order, than he has to still show that his income has changed to the extent that it is either 100 dollars or 20 percent difference in his child support payments from the prior order to the current situation. With that said, more facts are rquired aqnd the documents that have already been filed has to be reviewed. Consult a local attorney for assistance. My law firm is based in Houston and we focuse primarily in family law matters and bankruptcy. Good luck and wish you success.
