Am I screwed? Police lied on official report.

I was at a co-workers house, sleeping on his couch at 4 A.M. when I was awoken to someone shouting "This is the police". I got off the couch and peered into the hallway, an officer was standing there inside the house, came up & immediately arrested me. I came outside and my friend was sitting on the ground in handcuffs. They said they got reports of a person stealing out of cars and that my friend was the main suspect. I didn't understand why I was still under arrest and they would not talk to me. They eventually patted me down and searched my backpocket, finding the weed. The official police report says: I came out of the house on my own accord. The officer then asked me if I had anything he needed to know about. I then told him I had weed, took it from my pants n handed it over. My friend was found outside of the house when he was arrested. He told the police they could not enter without a search warrant. Later in the investigation when the police were trying to convince him to admit to burgalary and give back the stuff, he said he didn't do anything and they could look inside the house. The officers said "we can't go in the house, you already told us we can't go in without a search warrant". I started screaming you guys already came in the house and arrested me. They didn't respond. My friend was charged with burgalary and I was charged with possession of marijuana under 20 grams. The cop also kept my cellphone, wallet, and keys - never turning them into the jail or police station. What are my options?

If you continue to confess on the Internet, you will hurt yourself even more. You should seek a Broward county attorney who will get the discovery and review it for you and determine the constitutionality of the search and arrest.

You need to hire an attorney immediately. It is not uncommon for the police version to be completely different from a client's version. You have some issues that need to be addressed. At the very least you do not want a conviction on the marijuana charge so as to avoid losing your drivers license for two years. Good luck, James Davis

Absolutely get a lawyer and don't use websites like this to give facts that the DA may stumble on. Also, welcome to the real world where cops can lie and put you in jail.

You need to get an attorney immediately. Only an experienced criminal defense attorney can come up with a legal strategy to suppress the evidence, challenge the validity of your arrest and discredit the officer's statements. The story you tell is not that uncommon. Unfortunately, there is currently a list of nearly 150 officers who are under investigation in Broward for inappropriate behavior like you described.
