After a denial should an I-130 be refiled or should they start over and file a brand new one?

I'm a Paralegal working with a lawyer who is working an immigration case. The husband is very ill the wife is an immigrant he is a us citizen. They filed an I-130 form but for some reason didn't get all of the required paperwork in on time. Should they refile the same form or start over and file everything wih a clean slate. They don't want to turn the DHS attention to them so they are trying to do what's best for her to be able to stay. Please help me!

Why was there a deadline with the i130? Does not make sense

Ask the lawyer you are working for.

Why were they denied and how long ago? They may be able to file an appeal or request to reconsider and file the additional evidence. The best person to answer your question is the lawyer you are working for.

I agree that the attorney you are working for should be the one answering this question. Having said that, I also don't understand the question: re-filing the I-130 and starting over and filing a brand new one seems like the same thing - in either scenario you are paying the fee, filing an I-130 and submitting supporting documents, the only difference (as I read your question) is using the same form or filling out a new one (presumably with all the same information).
