He hasn't told the truth from the beginig and his families didnt approve of me, afterwards i found out he has been cheating on me so i filed for divorce. Now he is trying to claim the marriage as if it was a froud. We didnt live together because his mom was triyng to move out and i found out his cheating after that.My question is does he have the right to sue me for froud marriage while there was no froud. I have all kind of proof like e-mails wedding pictures at the church and friends and family who are willing to wittnes. what can i do ? Please help.

A fraudulent marriage for immigration purposes is one entered into solely to gain immigration benefits.

Marriage fraud "for immigration purposes" is when the parties enter into a marital relationship for the sole purpose of evading the immigration laws. Marrying someone "out-of-love" may not necessarily be considered marriage fraud. I suggest that you get the help of an experienced immigration attorney. ---------------------------------------- This email was sent by: , Inc. 1501 4th AveSuite 1900 Seattle, WA, 98101-1588, USA We respect your right to privacy - visit the following URL to view our policy. You should sit down with an immigration attorney so they can explain what a fraudulent marriage is, in terms that you clearly understand. If you need help in how to handle the divorce, you should direct this question to family law attorneys. Best of luck.

Hi, I ask that you definitely explore your options with regards to this marriage in a one-on-one consultation. You may have options depending on various factors of emotional/financial/physical abuse if there is any and the best way to know is to get screened through an attorney who has experience with such cases. Well - there are two things in play here. Divorce and Immigration. He can sue you for divorce based on fraud. But he has to prove it. As for immigration, it appears that you are OK now. So - unless he goes back and declares the fraud in your file, you have no issues. If he does, then you have to present your evidence and attempt to convince Immigration of your situation - which was horrible I may add.
