Post-nuptial agreement

3 views 3 answers
My husband and I have a post-nuptial agreement. It was written by his lawyer and ammended by both my husband and I. However, it is an agreement with very little technical/legal terms, typed & printed on a regular piece of paper, and never notorized. Does it still constitute as a lawful contractual agreement in the state of California? If my husband and I seek a divorce, will the courts take the agreement into consideration?

Without reviewing the agreement, it is difficult to have an opinion on whether the agreement is enforceable. You need to consult with an attorney who can review the agreement and the facts and give you specific legal advice.

There are many rules relating to pre and post nuptial agreements. Failure with any one of them could lead to an unenforceable agreement. You should take your documents to a family law attorney that is familiar with the requirements for a post nuptial agreement for a consultation.
