I want to file a age and disability discrimination and wrongful termination lawsuit against FedEx Ground. The EEOC has given me 90 days from 2/13/2012 to file.Human rights is still looking into my case. First I was fired for throwing a package which was a total lie unemployment agreed with me that there was no employee misconduct. Second I had knee surgery on April 6th,2011 and was not 100 per cent recovered when I was fired. Third I have severe Asthma and I was having trouble breathing well at work. Fourth I have filed for disability with SS and have retained Greenman Toomey for that. Fifth at the time of my termination I was 59 years old. Also I worked from 10/1/2008 to 6/24/2012 when I was fired until my knee surgery I never missed a single day of work!

I am sorry about your situation. It sounds as though you have taken the proper first steps in filing a charge. Good for you in being proactive here. I would be more than glad to speak with you about your situation. I, like many attorneys, offer free 60 minute consultations. During this meeting we would discuss the specifics of your matter, including the looking over of the accused's response/position statement, and from there we would together decide whether we want to move forward with the other, and act accordingly. There is no obligation with this consult. Adam W. Klotz 612.223.6767- Free Consultations

I am a California attorney and not eligible to give legal advice in your state. My comments are for information only, based on federal law and general legal principles. YOUR STATE MAY HAVE ITS OWN LAWS THAT PROVIDE SIMILAR OR GREATER PROTECTION. If I refer to your state's laws, that only means I did a quick Internet search and found something that appeared relevant. You should not rely on any comment I make regarding your state's law. You MUST check with an attorney licensed in your state. To find a plaintiffs employment attorney in your area, please go to the web site of the National Employment Lawyers Association (NELA). NELA is the largest and most influential bar association in the country for attorneys who represent working people. The web site is www.nela.org, and you can search for attorneys by location and practice area. Also, NELA has affiliates in every state and in many cities. On the NELA web site, you can look at the list of affiliates. Some attorneys will be listed in the affiliate membership list, some in the national organization membership list, and some in both. Being listed in one or both lists should not influence your selection because attorneys can choose whether or not to purchase the listing in the national directory. Each local affiliate has its own rules for listing. I hope you can resolve your situation and wish you the best.
