How often are landlords supposed to change carpets in NY

3 views 1 answers
I moved in an apartment four years ago. I am not sure if the carpets were new when i moved in but they were clean. I have recently moved out and I shampooed the carpets and left the apt very clean. My landlord now is stating that the carpets had to be professionally cleaned and if i could not show a receipt for the cleaning i would be be held responsible for the landlord to have them professionally cleaned or replaced. I heard that landlords are supposed to change carpets every 4 years , is that true?

Dear How often are landlords supposed to change carpets in NY? NY does not have a state law relating to carpet replacement in apartments. There may be a local law where you lived. Your lease will have the answer regarding your obligation as an exiting tenant to the carpets. If the lease is silent about "professionally cleaned or replaced" then it seems that your former landlord is trying to shake you down. If the lease made the carpet cleaning your responsibility, and you did something other than follow your agreement, your landlord might have a valid claim. In New York City landlords are required to paint leased apartments every three years, and most landlord and more tenants, skip out on enforcing that obligation. You may research the subject of the expected life expectancy of carpeting provided by a landlord in an apartment. The grade of carpet will also be useful in determining if there existed any reasonable expectation by the landlord relating to continued use of the carpeting after your tenancy. There may be depreciation formulae available to aid in calculating if the carpet was fully used or not at the end of your tenancy.
