How long does an employer have until they mail you your last check, or last 2 checks if need be?

Can the company keep your check? I owe nothing. I just left the job, couldn't stand the manager, she doesn't do her job and that's why this question is being asked. I asked her to mail my check to my home, through a text (no response) I now text the owner and they want me to fill a form out that states I left and wasn't fired, then when I mail it back, he said they will mail my check out. I don't mind filling out the form but just wondering legally if I have to fill out the form? If I don't, can they really keep my pay check? I am going to fill the form out, but how long can they hold my check for? I always thought when you left a job they have to mail your check to you as soon as they get them in? When is it considered late payment? I do not trust them to send me my check at all.

You should file a claim immediately with the Attorney General's Wage and Hour Division. This practice would appear to violate wage and hour laws. Retain counsel. A proven violation results in an award of triple your wages plus your attorney's fees.

When an employee leaves, the employer is required to make the final payment at the next regular pay day. If you were terminated, it would have to pay you that day.

You do not have to complete the form in order to receive your final pay. The company may want you to sign the form to avoid paying you unemployment.

You should get paid at the next regular payday. If you normally get paid every other Friday, you'll get paid as usual--if you normally get paid every Thursday, then you'll get paid as usual. You do not need to sign the form in order to get your paycheck. They are probably trying to avoid an unemployment claim.
