I have no access to his personal checking account, or any money at all. I have been maintaining the household and caring for the children while he works and provides the income. We recently have been having marital problems, which I don't think we will recover from. Our marriage is pretty much done. He has cut me off from having any access to money. I have no money for gas or to buy the things I need for the home or my own personal items. He won't let me go grocery shopping. He's been buying junk and getting fast food to feed the kids. We're still married and living in the same home. What can I do legally to have access to the household money until I can find a job? Isn't this financial abuse?

The state is not going to intervene in financial matters between spouses until one of you files a petition for dissolution of marriage or legal separation. Once you have filed a petition with the court, you can ask the court for temporary orders that may include the husband releasing some of the cash to you until the court can enter final orders. If you both are struggling financially, there may not be much cash available to support both households. You likely will need to find a job or get training to find a job. You should review your specific facts with your attorney to find out your legal options.

You can file for dissolution of your marriage (divorce) or a legal separation and ask for temporary orders so you get money flowing to you to cover your needs and the kid's needs. There is another procedure called separate maintenance that does not involve divorce, that fits your situation, but is rarely used. Basically, you need a court order saying who will pay what bills, and how much money he will provide you. See an attorney. Many family law attorneys will give you a free consultation so you can learn what to expect. Good luck. - Glenn

You need to retain an attorney and get into court as soon as possible. The longer you wait the longer it will be until you have financial support from him. Borrow the money to get an attorney if you have to.
