Is it possible to get off of informal probation early if i have not had any other incidents?

I have been in the military 7 years and i was involved in a misdemeanor hit and run 2 years ago in which i was sentenced to pay a fine, do 7 days of community service and 3 years of informal probation. Is there anything i can do to possibly get off of my informal probation. I paid the fine immediately and completed my community service a few months after getting the sentence. I have never been in any other trouble and have not had any incidents since then?

Yes, you can request early termination of probation by writing a motion and then actually requesting to dismiss the charges if granted. Feel free to call me with any questions. Elliot Zarabi www.zarabilaw.com 213-612-7720

You can petition the court to terminate your probation. California Penal Code section 1203.3 allows a judge to terminate a defendant's probation ahead of schedule if you paid all of your fines and you can show that you you've been a model citizen. Hiring an attorney would be well advised.

Absolutely. Here in San Diego, in cases like yours, the Court will usually entertain a motion to terminate probation under Penal Code 1203.4, early once you have gone about half the term. For you that would be 18 months from your plea. You probably should have a lawyer do the motion because the prosecution can object and fight it. If you have a very compelling reason, especially related to your military service, probation can be terminated even earlier sometimes. Then, after the motion is granted, you can get your record expunged. Good luck.
